Rights of the Disabled

  • the employer fails to make a reasonable accommodation of a disability, or
  • the employer takes other discriminatory action against the employee because of current disability, or
  • the employer regards the employee as disabled when they do not have a disability recognized by the Americans with Disabilities Act, or because of a medical record of disability despite successful treatment.

Disabled persons who cannot work because they are unable to perform essential job functions may apply for short term disability, long term disability, Social Security or private disability retirement benefits. Veterans suffering from a service connected disability may be eligible for disability benefit payments, grants for housing adaptation, an allowance for aid and attendance of caregivers, and vocational rehabilitation programs.   A disability insurance policy may  provide benefits for persons who cannot engage in their own occupation.   Some disability insurance policies provide benefits for partially disabled insureds.
